LIFE FITNESS CENTER shall not be liable, to the extent permitted by applicable law, for any loss of money, data or other damage that may arise from:

unauthorised access to a user’s account;
leakage of personal data or a security breach caused by a cyberattack or other unlawful action by a third party;
misuse, disclosure or insecure storage of passwords or verification codes by the user;
use of insecure devices, networks or connections by the user; or
incidents or technical failures outside the reasonable control of the business.

The above limitation does not apply to the extent that the business’s liability cannot legally be excluded or limited.

Third Parties and External Websites

Our website and/or electronic services may contain links to third-party websites, applications or services.

Once you select a link and are transferred to a third-party website, application or service, the business has no control over the content, security, cookies, data-processing practices or privacy policy of that third party.

User Responsibilities

Users are responsible for maintaining the security of their personal data and access credentials, including passwords and verification codes.

Users are advised to:

never share their passwords with third parties;
change passwords when necessary or appropriate;
avoid storing passwords on insecure devices or services; and
notify us promptly if they notice suspicious activity on their account or suspect that their access credentials have been compromised.

Photography and Video Recording Inside Our Premises

The business reserves the right to take photographs and/or make video recordings within its premises for the purposes of promoting and advertising the business and its services, including publication and promotion through social media, in accordance with applicable personal-data protection legislation.

If a member does not wish to appear in photographic or audiovisual material created by the business, the member may contact the Reception/Administration Office in order to obtain information and submit the relevant request. Such requests will be handled in accordance with applicable legislation and the data subject’s applicable rights.

The business also displays notices in visible areas of its premises regarding photography and video recording by members or third parties.

Photography and/or video recording by a member or third party inside the premises is permitted only on the condition that the person making the recording has obtained, where required, the appropriate consent or other lawful basis for the recording, use and publication of the material and of the persons appearing in it.

Absolute Prohibition in Changing Rooms, Showers and WCs

PHOTOGRAPHY AND/OR VIDEO RECORDING IS STRICTLY, ABSOLUTELY AND WITHOUT EXCEPTION PROHIBITED IN CHANGING ROOMS, SHOWERS AND WCs.

This prohibition applies regardless of whether or not other persons are present in those areas at the time of recording.

The prohibition applies to every form of photographic or video recording, regardless of the medium, device or technology used, including, without limitation, mobile phones, cameras, video cameras, tablets or other devices.

Photographs and Videos Independently Recorded by Members or Third Parties

If a member or third party independently takes photographs or videos and subsequently uploads, shares, publishes or otherwise makes the relevant material available on social media or any other medium, responsibility for the lawful recording, use and publication of the material, as well as for obtaining any required consent or other lawful basis from the persons appearing in the material, rests exclusively with the person who made the recording and/or publication.

The business is not responsible for photographs or videos independently recorded and shared by members or third parties without the instruction, involvement, approval or control of the business in relation to the particular recording or publication, subject to any obligations imposed by mandatory applicable law.

In any event, the business does not provide permission or consent for members or third parties to publish the personal data of other persons and recommends that everyone using its premises complies with applicable personal-data protection legislation and respects every person’s right to privacy and protection of their image.

Rules of Proper Operation

By registering, you accept the operating rules of the gym.

Management reserves the right to amend the operating rules for the better operation of the gym and always for the benefit of the majority of members.

Gym management also reserves the right to terminate the cooperation and/or membership of any member who fails to comply with the above rules and the gym’s operating regulations, in accordance with the applicable terms and legislation.

Consent and User Rights

By registering with our services and using our services, you acknowledge that you have been informed of this Privacy Policy and the applicable cookie policy.

Where processing is based on your consent, you may refuse to provide consent or withdraw your consent at any time, in accordance with applicable law. You may also request the processing, correction or deletion of your data to the extent that the relevant rights apply to the particular processing activity.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal, where provided for by applicable law.

What We Collect

Registration and Profile

The creation and management of a member account relating to LIFE FITNESS CENTER services and functionalities is not carried out directly through the LIFE FITNESS CENTER website. The relevant procedures are carried out and/or facilitated by the Reception/Administration Office of LIFE FITNESS CENTER at its premises, as part of the member registration process and the provision of the relevant services.

During the registration process and the creation or activation of the relevant account, users may be asked to provide certain information, such as their full name, username, email address and password.

Additional information relating to the creation, activation and security of the account may also be recorded or stored, such as the registration date, account-confirmation date and the IP address used, depending on the particular service or technology platform being used.
